AN ANGRY ex-girlfriend slapped her former partner before kicking and punching his Audi after he refused to return her children, a court heard.
Jamie Etheridge, 30, had been at the home of his new girlfriend Danielle McCoy, 25, on September 19, when Hayley Peglar arrived to drop off the children she shares with Mr Etheridge.
An argument then ensued which resulted in the 29-year-old, of Wychbold Crescent, Kitts Green, slapping her former lover round the face before turning her attention to the car to “get him where it hurts.”
Malcolm Stoddart, prosecuting, said: “It is domestic violence in effect. They are ex-partners. They split up a few years ago after a lengthy relationship from which they have children together.
“Etheridge was at his new partner’s address in Cooks Lane [Kingshurst]. The defendant arrived to drop off her children. An argument happened which turned into a slanging match. There was a blow to the face of Mr Etheridge.”
But Sanjit Singhara, defending, said the assault was the result of a “substantial amount” of provocation.
“What occurred on the day was a repetition of Mr Etheridge’s behaviour whenever she drops off the children,” he said.
“On each and every occasion, Mr Etheridge is abusive towards her and insulting.
“In frustration and anger she accepts she slapped him to the face.
Returning to the property later that evening, she punched and kicked the car outside.
Peglar pleaded guilty to assaulting Mr Etheridge and causing criminal damage to his black Audi A4 and “booting” Miss McCoy’s front door, damaging the hinges and lock.
She was handed a conditional discharge for 12 months and ordered to pay £200 compensation to Miss McCoy, £300 to Mr Etheridge, £85 costs and £15 victim surcharge.
