The motorway was closed in both directions between junctions seven and six after the Nissan Cabstar van smashed through safety barriers on the A45 bridge on Monday (March 19).
It landed on the southbound carriageway of the M42 below and hit a Ford Mondeo and a Manbox van - although both drivers escaped injury.
Paramedics from the Midlands Air Ambulance Service, stabilised the van driver who was then taken to hospital by land ambulance with severe head, chest and abdominal injuries.
But the 35-year-old, from Shard End, passed away in Walsgrave Hospital at 6.49pm later that day.
One lane of the northbound carriage was reopened but the M42 southbound remained closed for over four hours while a forensic examination of the scene took place.
